1. What zoning district is my property located in?
The zoning map is available on the town’s website. If you have trouble reading it, please call the Planning & Zoning Division.
2. Where can I find the regulations for my zoning district?
In Article V, Land Use, Density and Intensity, of’ the Land Use and Development Code (LUDC) contains all of the regulations for each zoning district within the town. A link to these regulations can be found on the Planning & Zoning Division's web page.
3. What is the Gordie Preston line?
The Gordie Preston line is an imaginary line used for setback purposes on oceanfront properties. The line is drawn from the easternmost portion of the building to the north and south of a property to determine how far to the east a structure can be built without blocking the view of that structure.
4. How do I apply for a variance from these regulations?
Variance requests from the regulations of Article V are heard by the Board of Adjustment. Variance requests from the regulations in any other article of the LUDC are heard by Town Council.
5. Do I need a permit to cut down a tree?
We have strict tree removal regulations, so it’s always best to contact Planning & Zoning staff. A permit is required to remove specimen and historic trees unless it is dead, weakened by disease, or causing property damage.
6. Are there certain trees or plants I should not plant on my property?
There are some species of trees and plants that are invasive and whose growth chokes out native species. These include, but are not limited to, the Brazilian pepper, air potato vine and smilax vine. We do have a list of plants that do well here in Ponce Inlet available at Town Hall. And we do encourage the planting of native species.
7. Can I plant anything in the right-of-way?
A Right-Of-Way Use Permit from the Public Works Division is required prior to any planting in the right-of-way.
